Manpower Introduces Several Changes To Private Sector

KUWAIT CITY, July 13: Director General of Public Authority for Manpower Ahmad Al-Mousa has issued a number of decisions to organize and introduce several changes to the private sector and oil sector.

According to one of the decisions, work permits can be issued to expatriate personnel for three years, renewable thereafter. The application for renewal of work permit can be submitted three months before the expiry date of the work permit.

Work permits can be issued for illegal residents (Bedoun) for one year, renewable thereafter.

Al-Mousa issued another decision to allow an expatriate worker to transfer their work permit to a different sponsor after three years from the date of its issuance without consulting the employer, provided the employer is granted the allotted notice period.

It allowed the transfer of dependant visa to private sector’s work visa after the visa holder completes one year of residence in Kuwait, as per the procedures applied by Ministry of Interior.

The decision also allowed transferring the sponsorship of workers, who were brought to the country on work permits of private sector, after one year from the date of issuance of the work permit and with the approval of the employer to transfer the sponsorship.

It also allowed transferring the sponsorship of workers, who were brought to the country on work permits of private sector for government contracts and projects after completing their original contract. However, the transfer must be to another government contract of the same employer if any or to another governmental contract of another employer; but this is exclusively for specialized technical workers.

Another decision Al-Mousa took was that the authorized signatory or attester of any official document should be a Kuwaiti or a GCC citizen. Non-Kuwaiti partners’ signatures are allowed for renewal of work permits only.

Another decision was issued to approve a new mechanism for cancelling economic license. Al-Mousa gave the private sector the right to employ male and female juveniles between the ages 15 and 18 after obtaining permission of Public Authority for Manpower and approval of their guardians based on the demands of the employer and after conducting necessary medical examination.

He banned employment of juveniles in sectors such as painting, cement plants, mines, soda factories, pesticide manufacturing, drainage maintenance, filing of gas cylinders and electrical batteries industries.

He issued another decision to allow women to work at night in sectors such as hotels, pharmacies, offices of attorneys, medical labs, entertainment gardens, children nurseries, medical centers, theaters, cinemas and TV stations and satellites.

Women can work until midnight in banks, restaurants, cooperative societies, educational institutions, saloons, touristic offices, commercial markets and complexes.

Al-Mousa banned employment of men in service sectors related to women clothing, ladies saloons, cosmetics stores, and women health institutes, instructing labor departments not to issue or renew any work permits for men working in these fields.

A decision was also issued to grant female employees two hours during working hours to breastfeed their children, provided they submit the required official documents in this regard.

The employees will lose this right after the breastfeeding children turns two. In addition, female Muslim employees can take fully-paid leave for four months and ten days from the date of their husbands’ demise.
